Terms of Service

Effective Date: January 29, 2026

1. Services

We provide website design, setup, and optional ongoing hosting, domain management, and maintenance services. Websites are created using modern tools to deliver fast, affordable, and professional results.

2. Payment & Fees

  • One-time website setup fee: $499
  • Monthly hosting, maintenance, and domain management fee: $29.99
  • Payments are processed securely through Stripe
  • Monthly fees are billed automatically until canceled

3. Refund Policy

Due to the custom nature of our services:

  • Setup fees are non-refundable once work has begun
  • Monthly subscriptions may be canceled at any time by contacting us at joaquinkeonimenendez@gmail.com; no refunds are provided for partial billing periods

4. Website Ownership

  • The client owns all business content they provide, including text, images, logos, and business information
  • We retain ownership of the underlying code, templates, systems, and tools used to create the website unless otherwise agreed in writing
  • The website is licensed to the client for use as long as the monthly subscription remains active

5. Domain Registration & Management

As part of our website setup services, we will purchase, register, and manage a domain name for the client.

  • Domain registration fees for a reasonably priced domain are included in the one-time setup fee
  • Domain selection is subject to our approval based on availability, pricing, and technical suitability
  • We reserve the right to decline domain names that are premium-priced, unavailable, misleading, infringing, or otherwise unsuitable
  • If a mutually acceptable domain name cannot be agreed upon, either party may decline to proceed with the sale prior to work beginning

Ongoing Domain Management

  • While services remain active, we manage domain configuration, DNS settings, and renewals
  • Domain renewal fees are included in the monthly hosting and maintenance subscription

Domain Ownership & Transfer

  • The client retains ownership of the domain name
  • Upon cancellation of services and payment of any outstanding balances, we will provide reasonable assistance to transfer the domain to the client or their designated provider
  • Domain transfers are subject to third-party registrar policies and timelines
  • We are not responsible for domain availability, trademark conflicts, registrar restrictions, or issues arising from third-party domain providers
  • We are not responsible for losses resulting from domain expiration after services have been canceled

6. Hosting & Availability

We aim to provide reliable hosting and high uptime but do not guarantee uninterrupted service. Temporary outages may occur due to maintenance, updates, or third-party providers.

7. No Guaranteed Results

We do not guarantee traffic, leads, revenue, search engine rankings, or business outcomes. Our services are designed to improve online presence, usability, and professionalism.

8. Client Responsibilities & Website Updates

Clients are responsible for:

  • Providing accurate and complete business information when requested
  • Ensuring they have the legal right to all materials submitted
  • Reviewing and approving all website content for accuracy, completeness, and compliance before and after launch, including text, images, contact details, services, pricing, and business information
  • Requesting any corrections or changes promptly

Website Updates

  • For the first fourteen (14) days after initial website delivery, clients may request reasonable updates or adjustments to the website layout, content, or design
  • Ongoing updates to factual business information (including hours of operation, address, phone number, pricing, or service details) are included for the duration of the active subscription
  • Requests involving major redesigns, new pages, or changes beyond the original scope may be subject to additional fees
  • We are not responsible for errors or inaccuracies in content that has been reviewed and approved by the client

9. Termination

We reserve the right to suspend or terminate services for non-payment, misuse, or violation of these terms. Upon termination, access to hosting and managed services may be discontinued.

10. Limitation of Liability

Our total liability is limited to the amount paid by the client in the thirty (30) days preceding any claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law

These terms are governed by the laws of the state in which our business operates, without regard to conflict of law principles.
